Arson Case Dropped

The Case

Attorney Zahra Umansky represented a client who was recently charged with arson of a conveyance, which basically translates to him being accused of setting his vehicle on fire. Unfortunately, this alleged incident occurred at his home, right in his driveway. Instead of law enforcement and the fire department helping the client, they accused him of being the one that set his own vehicle on fire. The arson investigator threw together a case which we believed was based on hunches and speculation and no real evidence.

The investigator went out and got an arrest warrant signed for our client’s arrest. However, Zahra Umansky was successful in showing the prosecutor witness statements that outlined the client was not involved in this, as well as relevant paperwork from an insurance company indicating that the client had nothing to do with the incident. Attorney Umansky was successful in getting the charges dismissed against the client dropped for a second-degree felony, which is a grave crime. He could have faced up to 15 years in prison, a $10,000 fine, and/or 15 years probation for an arson charge.

Dedicated  Orlando Arson Lawyers

Arson is a serious crime due to the fact that it is essentially purposefully creating a natural disaster. Fires are capable of affecting a widespread area, so when this is intentional, the repercussions could be overwhelming. When this is a situation bringing insurance motives into question, then you have another situation where fraud and dishonesty are involved. Being involved in an arson case can be a troubling time when the number of charges starts to pile up – it could be in your best interest to hire a criminal defense attorney who has worked on arson cases specifically. Since many lawyers won’t deal with this particular charge as often as other ones, it is essential you do research finding out which lawyers in your regions are best suited to handle an arson charge.

As it is law enforcement’s duty to investigate possible criminal matters, it’ll be your lawyer’s duty to provide you with adequate legal services. This is not something you could expect to receive from a criminal defense attorney who has never handled an arson case before. In such instances, your case will be a learning experience for the attorney as they’ll likely use shortcomings in the mitigation of your case to improve upon for the next client. By entrusting your case to an experienced arson lawyer, you better your chances of them getting it right the first time around. Your knowledgeable legal representation will be capable of doing the following and more:

  • Thoroughly investigate the presented evidence and provide trial representation to disprove allegations of arson
  • Engage in negotiation with the prosecution to lessen criminal penalties as much as possible and settle on an alternative to prison time

If you’re facing similar arson charges, or arson involving a structure, please call The Umansky Law Firm at 407-288-3838 and speak with an attorney to arrange a free consultation and case review. We can make you aware of your legal options moving forward and start constructing your defense.
