Orlando Trespassing Defense Attorneys

Orlando Attorney

You are in Orlando for a night out with friends or family. Perhaps you live here. Perhaps you are on vacation. You spend some time at Universal Studios. Then you go to a nightclub or two. You visit the Hard Rock Cafe, the House of Blues or some other club on the CityWalk or elsewhere. You have a few drinks. Perhaps you have one too many.

What Is Trespassing?

Criminal trespass is committed when a person enters a property when the person knows he or she does not have the right to enter. It is also considered criminal trespass if you have stayed on the property after learning that you have no legal right to be there.

This crime can be committed on either public or private property. It is important to note that you do not need a verbal warning that the property is off limits.

Refusing to leave or returning after you have been told to leave is also criminal trespassing. For example, you don’t commit any crimes, but you end up getting kicked out of a club. Later, you enter the same club, maybe by mistake or to gather your family and friends. You end up getting arrested and charged with trespass without warning because you entered an establishment that you had been kicked out of. This is a surprisingly common scenario.

Penalties For Trespass Charges

The types of consequences you are facing on a trespassing charge depends on where you were allegedly trespassing. Whether it was on property, on school grounds, in a structure or in a conveyance, you may be facing some of the below types of penalties. The circumstances surrounding your alleged trespassing may also enable the prosecutors to enhance the charges, leaving you facing more serious penalties:

Second-degree misdemeanor:

  • Jail: Up to 60 days
  • Probation: Up to six months
  • Fines: Up to $500

First-degree misdemeanor:

  • Jail: Up to 12 months
  • Probation: Up to 12 months
  • Fines: Up to $1,00

Third-degree felony:

  • Jail: Up to five years
  • Probation: Up to five years
  • Fines: Up to $5,000
