Terrorist attacks have resulted in over 3,600 deaths between 1995 and 2016. While earlier concerns of terror were mostly geared toward groups in Islamic nations, the recent and dramatic uptick in school and club shootings has put an entirely new face on terrorism. Whereas seemingly insignificant threats of violence may have been looked over in the past, Central Florida law enforcement officers are now taking all threats of terror seriously.

What Exactly is a Threat of Terror

Florida Statute § 775.30 defines terrorism as “A violent act or an act dangerous to human life which is a violation of the criminal laws of this state or of the United States… intended to

  • Intimidate, injure, or coerce a civilian population;
  • Influence the policy of a government by intimidation or coercion; or
  • Affect the conduct of government through destruction of property, assassination, murder, kidnapping, or aircraft piracy.”

Per Florida Statute § 815.06, terrorism also extends to include “offenses against users of computers, computer systems, computer networks, and electronic devices.” Some common examples of terrorism include threatening to:

  • Physically harm or kill an individual
  • Discharge hazardous materials
  • Use or build a bomb to destroy property
  • Cause damage to terrorize others
  • Use a symbol to terrorize others
  • Commit any act of violence

Those facing charges for making a terrorist threat should take them seriously. The State will strive to make an example out of you to deter others from doing the same. This remains true no matter if you did this as a prank or had sincere intentions. In either case, you should be aware of the criminal penalties associated with the crime.

Florida Penalties for Threatening Terror

Anyone who threatens to commit an act of terror in Florida has committed a second-degree felony punishable by:

  • Up to 15 years in prison; or
  • Up to 15 years probation;
  • $10,000 in fines

Those who go through with an act of terrorism will be charged with a first-degree felony punishable by up to 30 years in prison or probation and $15,000 in fines. If that act of terror causes “serious bodily injury,” they can be charged with a life felony.
