Many people are under the misconception that the only way to be charged with domestic violence is if you're actually married to the person. That's not true. The Domestic violence statute basically lists four different statutory criteria that explain the different relationships amongst people that would qualify as a domestic relationship.

  • Be married to the person.
  • Formerly married to the person
  • Have a child in common, or
  • To be cohabiting as if in family

With regard to getting the case dropped, that's a tough question to answer. Many things go into whether a prosecutor decides to proceed with the case. Usually in a domestic violence case, in order for the state to be able to proceed with a trial and actually prove the allegations against you, they have to have a cooperative victim. The caveat is, the only witness in the case is the alleged victim. Something happens at home and the police get called. The officers weren't present and don't know what happened. Chances are there was probably nobody else at home, as well. If the prosecutor does not have a victim that's willing to testify, or is now recanting their story and basically saying that it was all big mistake, it's going to be very tough for the prosecutor to approve this charge. Certainly, we can never guarantee whether a case will get dropped or not. It's dependent on whether the victim was cooperative.
