Defendant was allegedly masturbating in a peep show booth at an adult book store in Brevard County. Brevard County Sheriff's Deputy arrested the Defendant and charged him with exposure of sexual organs. Attorney Gergely of the Umansky Law firm filed a motion to dismiss alleging among other things that the Defendant was entitled to an expectation of privacy in his peep booth and that the defendant was not engaged in a violation of Florida Statute €800.03. The County judge agreed and found that the defendant had an expectation of privacy in the peep booth at the adult book store and granted an order dismissing the case.
