Lindsey Gergely recently had a couple of DUI cases with a few difficult sets of facts. The first one was a case where a client was a 20 year old student who blew two breath test levels over a .3, which is over 3 times the legal limit in the state of Florida. Ms. Gergely went to court to file a pre-trial motion to suppress on this case. She was able to convince the prosecutor to give the client a reckless driving charge, because the DUI in Orlando was her first offense. Attorney Gergely was also able to get her a "withhold of adjudication" on that reckless driving charge. Once she's done with probation and all of her conditions, she should be able to seal her case. This was ultimately a favorable resolution for the client who blew that high of a breath test level.

Lindsey Gergely represented a first time DUI offender whom had some prior driving on suspended license cases. This client came before the same judge and the same prosecutor and we filed the same type of motions to suppress. In that case, Attorney Gergely was able to speak with the law enforcement officer when the client got there and convince the officer that the client was going to lose his job if he had plead to a DUI because he was going to lose his driver's license. Because of that, Ms. Gergely was able to convince the prosecutor, as well as the law enforcement officer, to give the client a reckless driving charge.
