Just as we do for victims of other types of violent crimes, our lawyers will sue a perpetrator or other responsible party for damages, including pain and suffering, mental anguish, and medical expenses.
Unlike criminal court, where guilt must be proven beyond a reasonable doubt, in a civil setting we must only persuade the jury that the defendant's guilt by a preponderance of the evidence, i.e. he or she is "more likely than not" responsible. A defendant who was found not guilty in criminal court can still be held liable in a civil trial. However, if the defendant is convicted of a sex crime in criminal court, we will work to obtain punitive damages for our client in civil court.
Even if the perpetrator is in prison or insolvent, we will analyze your case to identify other possible sources of financial compensation such as the owner of the nursing home that employed the offender, or the owner of the inadequately lit parking lot where you were assaulted.
