What is a Habitual DUI Offender in Florida

In Florida, you could be charged as a "habitual traffic offender" if you have:

  • Three or more traffic convictions in a five- year period for DUI, driving without a license or on a suspended license, hit and run involving injury, leaving the scene of an accident, vehicular homicide, or any other felony conviction that involves the use of a car (such as armed robbery).
  • In some instances, 15 moving violations in which points were put on your permanent driving record with the Florida DMV

Habitula DUI Penalties in Orlando

A second arrest can mean serious consequences, such as financial sanctions upward of $1,000 and/or up to nine months in custody. A conviction could also mean mandatory completion of alcohol and psychiatric counseling. In some cases, the courts will order that the offender install and pay for an ignition interlock device on his or her vehicle for a minimum of 12 months.

Depending on the time frame between your multiple DUI convictions, you will lose your driver's license for six to 12 months; in some cases, you could lose it for as long as five years. Your vehicle could be rendered immobile for a month.

It is important to know that additional DUIs carry increasing penalties. You will be punished more severely the more DUIs you have.

Challenging Your DUI Case Whenever Possible

When the police administer Breathalyzers, they must be certified to perform the test. The machines need to be regularly calibrated and maintained, or the results will be considered invalid. A subject's medical issues, such as diabetes, acid reflux or dietary challenges, can also affect the results of a Breathalyzer. When administering field sobriety tests, the surface might be bumpy or rough, which can also negatively affect the results of the test. A number of additional factors can affect the outcome of your case.
