Did the Police Entrap Me?

Craig's List Police Entrapment Information

As a criminal lawyer who practices in Orlando and Central Florida. I have handled many prostitution, assignation, and solicitation cases. I am constantly questioned by escorts who may or may not engage in prostitution the following question: DID THE POLICE ENTRAP ME?

I usually respond by asking them a question. "Did you put an add on Craig's list that the police responded to?"

In many cases the escort did post an ad with Craig's list and with a few photos and some suggested language, the defense of entrapment has been severely compromised.

It is becoming increasingly popular for escorts to use the listing service in Craig's list under erotic services to offer dates of companionship to males in Osceola, Orange, Seminole, Brevard, Lake, and Volusia counties. Many of the individuals seeking these services are business men on travel and local guys looking to satisfy certain needs.

For instance, from my experience practicing law here in central Florida, I have many escort clients who got arrested after a sting operation where they listed their services for hire utilizing Craig's list to offer their services. They often posted naked or scantily clad pictures of themselves in suggestive poses, or in many instances they described in particular their services utilizing coded language such as GFE, hugs and kisses, and travel to exotic destinations among other language.

These women will then get a call from an undercover agent who is posing as a man trying to utilize their services. The escorts will show up at a hotel, enter the undercover agent's room and engage in a conversation that ultimately leads to a discussion about sex and money. The escort will then get arrested for the charges of solicitation, assignation, or commission of prostitution. In many instances law enforcement has either video taped, recorded, or transcribed the encounter.

In a nutshell, if you are posting adds under the erotic services in Craig's list that display pictures of yourself and/or desire services you are offering, it is quite difficult then to claim that the police "made you do it," because the defense of entrapment when its boiled down to common sense from a jury's perspective is that the police engaged in behavior that caused you as a private citizen to commit a criminal act you normally would otherwise not engage in. I could go on specifically about the legal requirements of both objective and subjective entrapment here in the state of Florida, but it is sufficient to say that if you are engaging in escort activities and you are posting nude or scantily clad suggestive pictures of yourself on the internet and describe the services that you offer it will be very difficult to convince a judge or jury later on that the police entrapped you or made you commit a crime that you would not normally engage in.
